By accessing or using promotion.gg, you agree to these Terms of Service and any additional order-specific, pricing, billing, or service documents that apply to your use of the platform or the services purchased through it.

If you are using the platform on behalf of a company, brand, or other entity, you represent that you have authority to bind that entity to these terms.

promotion.gg is the client-facing frontend for AudienceDev. It may be used as a public sales and marketing site, a customer login and dashboard, and a delivery telemetry interface for services such as Website Views, Platform Views, and Ad Management.

The platform may include one-time services, subscriptions, retainers, custom scopes, billing workflows, telemetry views, and internal or partner-operated service delivery systems.

You must provide accurate, current, and complete information when creating or using an account. You are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account.

You must notify us promptly if you suspect unauthorized access, misuse, or a security issue affecting your account.

Services, pricing, quantities, renewal structure, delivery scope, timelines, and billing cadence may be described on the site, at checkout, in an order confirmation, or in a separate written agreement. The applicable order or agreement controls where there is a conflict.

Website Views and Platform Views may be offered as one-time services or subscriptions. Ad Management may be offered as a retainer. Recurring charges, renewal behavior, and cancellation timing should be determined by the applicable checkout flow, invoice terms, order form, or written agreement.

We may refuse, pause, or cancel an order where necessary to address fraud, abuse, legal risk, non-payment, operational limitations, missing customer inputs, or suspected misuse of the platform.

You are responsible for providing accurate information, lawful instructions, required creative assets, platform access where needed, and any approvals necessary for us to perform the services.

You are also responsible for ensuring that your use of the services, your campaigns, your content, and your destination pages comply with applicable law, third-party platform rules, advertising rules, intellectual property rights, and contractual obligations.

You may not use promotion.gg or any related services to violate law, infringe rights, impersonate others, interfere with platform operations, reverse engineer restricted systems, probe security, distribute malware, submit unlawful or deceptive content, or engage in abusive, fraudulent, or unauthorized activity.

You may not share account access except as expressly permitted by us or by your organization’s internal access controls.

You agree to pay all fees, charges, taxes, and amounts due under the applicable checkout flow, invoice, order, or written agreement.

If payment fails, is disputed, or becomes overdue, we may suspend access, pause delivery, cancel renewals, or require updated payment information before continuing service.

Unless otherwise required by law or expressly stated in a separate written refund policy or agreement, fees may be non-refundable once service delivery, provisioning, or committed work has begun.

The dashboard and telemetry views are intended to provide operational visibility into services and account activity. They may contain estimates, snapshots, delays, or third-party derived data and should not be treated as audited financial statements or legal records unless expressly stated otherwise.

We may change metrics, visualizations, and reporting methods over time as the product evolves.

promotion.gg, its software, branding, interface elements, site content, and related materials are owned by us or our licensors and are protected by law.

Except for limited rights necessary to use the platform as intended, these terms do not grant you ownership of our software, marks, content, or materials.

You retain rights in content you provide, subject to any permissions reasonably needed for us and our providers to host, process, display, transmit, or use that content to perform the services.

The platform may depend on or integrate with third-party services such as hosting providers, payment processors, authentication tools, analytics vendors, ad platforms, and social or content platforms. We are not responsible for third-party services beyond our own legal obligations.

Your use of third-party services may be subject to separate terms and policies.

promotion.gg and related services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We do not guarantee uninterrupted availability, error-free operation, or specific business outcomes such as revenue, rankings, conversions, audience quality, platform treatment, or future growth.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, goodwill, or business interruption arising out of or related to the platform or services.

To the fullest extent permitted by law, our aggregate liability for claims arising out of or related to promotion.gg or the services will not exceed the amount you paid to us for the specific services giving rise to the claim during the 12 months before the claim arose, unless a separate written agreement states otherwise.

You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, judgments, losses, costs, and expenses arising out of your content, your campaigns, your misuse of the platform, your violation of these terms, or your violation of law or third-party rights.

We may suspend or terminate access to the platform or services at any time if we reasonably believe you have violated these terms, failed to pay amounts due, created legal or security risk, or otherwise made continued service impractical.

Termination or suspension does not relieve you of payment obligations that accrued before termination, and provisions that by their nature should survive termination will survive.

We may update these Terms of Service from time to time. If we make material changes, we may revise the effective date and take additional notice steps where appropriate.
